As of 25.05.2018, Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, also known as GDPR (General Data Protection Regulation), shall enter into force in all European Union (EU) Member States.

GDPR strengthens the old legislation and makes it uniform throughout the EU. Romania currently has Law no. 677/2001 for the protection of natural persons with regard to the processing of personal data and on the free movement of such data, the provisions of which have already been applied by IELM (FILIP AND FAMILY). In any and all contractual documents, references to Law no. 677/2001 shall be replaced by references to GDPR.

  1. Who is iELM?

iELM (Filip and Family SRL) was established in 2013 in Sweden. We are a small family business that designs and produces limited edition clothing items and whose aim is to dress children in unique clothes at the right price. We currently have over 80,000 customers and over 100,000 followers on Facebook, with the intention to expand across Europe.

"Personal data" is represented by any and all information by which you can be identified. Such information includes items such as your name, an identification number, your phone number, e-mail address, postal address, username, location data, online identifier, one or more elements specific to physical, physiological, genetic, psychological, economic, cultural or social identity, personal preferences and browsing habits, generated content, your computer’s IP address, your device’s MAC address, as well as information from your cookies, as regulated via the General Data Protection Regulation, whose purpose is that of protecting all EU citizens’ confidentiality and preventing data violations.

Any operation or set of operations conducted on personal data or on sets of personal data, with or without the use of automated means, such as: collection, recording, organization, structuring, storage, adapting, modifying, extracting, consulting, revealing through transmission (including to third parties), dissemination or making available in any other manner, adjoining/alignment, blocking/restricting, deleting or destroying.

Personal data processed by IELM (FILIP AND FAMILY) comprises the following categories of natural persons: clients (even after contract termination), legal or conventional representatives of the client, persons with proxy powers on the account, additional card users, co-debtors, endorsers, real beneficiaries, as well as their family members.

We collect data from you via websites, forms, orders. You provide data to us directly when you contact us, when you purchase from our websites, and we receive data indirectly from cookies, in order to understand how you use the website and to provide you with relevant data.

This means that we may collect personal data on you in certain situations (sending newsletters, re-targeting with ads viewers who have accessed iELM websites, grouping at web interest level those who enter iELM websites and use this information for marketing purposes) mentioned in the table above.     Your data is stored in a country located in the European Economic Area ("EEA").

    It may be transferred to providers working for us, such as detailed above. Some of these are located outside the European Economic Area, namely in the United States of America (as per the European Union-United States Privacy Shield). The transfer of this data may be done solely in a secure manner and in accordance with applicable regulations.

    Should we transfer your data to countries that do not provide an adequate level of protection for the data sent, we undertake to take any and all measures necessary to ensure that the third parties to whom it is transferred respect the terms and conditions of this Policy. These measures may include the direct control of standards applied by these third parties as an element of data protection and security and/or the execution of corresponding agreements (e.g. the standard contractual clauses adopted by the European Union Commission).     1. How long do we store your personal data?

    We store your data solely for the amount of time necessary to achieve the purpose for which we store the data, to satisfy your needs or to meet our legal obligations.

    To know how long your data may be stored, we use the following criteria:

    • When you purchase products and services, we store your personal data throughout the duration of our contractual relationship;

    • Should you participate in a promotional offer, we store your personal data throughout the duration of the promotional offer;

    • Should you contact us with a question, we store your personal data for the amount of time necessary to process your questions, but no longer than 3 years from the last correspondence;

    • Should you have given your consent for direct marketing, we shall store your personal data until such time as you unsubscribe or ask us to delete it;

    • Should cookies be stored on the computer, we shall store them for as long as is necessary for them to achieve their purpose (e.g. for the duration of a shopping cart cookie session or for session ID cookies) and for an amount of time defined as per local regulations and guidelines.
